How can I terminate my tenancy by letter?

Changing your home is generally a very time-consuming process and should be planned carefully and in advance. In order to ensure that the termination of your rental contract runs smoothly, we have provided you with all the necessary information below.
Termination options
In general, a rental agreement can be terminated at regular intervals or on an unscheduled basis:
Ordinary termination
The ordinary termination of the tenancy takes place under consideration of the period of notice, which in the case of Room Estate is usually three months. For example, if you wish to terminate your room as of March 31st, you must send the termination letter by the end of December at the latest. Make sure you send your letter in time: The postmark is not important, but the day the letter arrives at the landlord or is ready for collection at the post office. To be on the safe side, you should send your letter of termination at least three and a half months before the intended termination date.
Important: An ordinary notice of termination cannot be converted into an unscheduled move-out afterwards. This means that you may not provide a new tenant at an earlier point in time in order to free yourself from further liability.
Unscheduled move-out
If you want to move out earlier than the regular date, you can inform us in writing of an extraordinary move-out (here too, an e-mail, SMS, fax or similar is invalid). You can fill out the template for the unscheduled move-out attached at the bottom of this page and send it to us by mail. For reasons of proof, we also recommend that you send the notice of termination by registered letter.
Please note that you are liable for the rent until the next regular termination date. In order to free yourself from this liability, the tenancy law offers you the possibility to find a new tenant. Provide us with a suitable new tenant for your room so that we can release you from liability. The new tenant must be solvent and reasonable. Please note that we cannot help you find a new tenant and that you must take responsibility for this. However, we will advertise the room on our own platform from the date you move out. You can then easily share the link and search for a new tenant.
Letter for the termination of the rental agreement
The termination of the rent can only be made in writing and should be sent by registered letter to the address of the landlord for reasons of proof. Terminations by e-mail, SMS or other electronic media are invalid. In this case the tenancy is not terminated and continues to run. You will find a template for both the ordinary termination and the unscheduled move-out in your cockpit under My Community > Choose the Community > Download files. Please make sure to use the correct date and address.
In the case of a joint tenancy agreement, all fellow tenants must sign the notice of termination. In the case of a family apartment occupied by a married couple, both spouses must sign the notice of termination in any case. This is true even if only one spouse has signed the tenancy agreement. The same rule applies to registered couples.
Observe dates and periods of notice
The termination date is the date on which the rental relationship ends. It should not be confused with the date on which you send the letter of notice. The date of notice depends on the rental agreement. Please note that you may have a minimum contract period which extends beyond your notice period and thus delays the termination date.
