How can I sublet my room?

Is it possible to sublet a room or an apartment at Room Estate?

Yes, it is possible to sublet your room, whereby in principle Art. 262 CO applies. In this case we can only prohibit the subletting if:

  • the tenant refuses to inform the landlord about the conditions of the sublease;
  • the conditions of the sublease are abusive in comparison with those of the main lease agreement;
  • the landlord suffers substantial disadvantages as a result of the sublease.

For you, this means in plain language that you may only sublet your room if the following rules are observed:

  • The subtenant fits our target group (especially in case of shared living, the person must be between 18 and 25 years old and in education or employment).
  • The subtenant must be registered and approved by us.
  • The terms of the lease must not only be approved, they must also not be abusive (i.e. the rent and service fee must not be higher than in your lease)
  • You are and remain the contact person for us in any case

Please note that the above list is not conclusive and only addresses the most important points.

 

What do I have to do if I want to sublet the room?

Once you have found someone who wants to rent your room, you can proceed as follows:

  1. Make a written contract with the conditions so that it is ready to be signed by you and the subtenant (ATTENTION: do not sign it yet!)
  2. Send us the lease by e-mail to our support address.
  3. If and when we approve the lease, we will let you know.
  4. You can now sign the rental agreement.
  5. Send us a scan of the signed copy.

 

Is there a template?

Unfortunately, Room Estate does not offer a template for a sublease agreement. However, you can quickly find a template on the Internet. Just make sure that the template is in accordance with Swiss tenant law.

 

Can my new tenant take over the room as soon as I have given notice?

This is possible in principle. Your subtenant can rent the room after termination in exactly the same way as everyone else. Simply register and rent after verification. However, there is no guarantee that we will accept this person. In addition, the person must leave the room for one day so that cleaning can be completed and the room can be inspected.

 

What else do I have to consider when subletting?

In any case, you should consider the following things when subletting:

  • From now on you are the landlord and take the risk that you will not receive any rent and that under certain circumstances the tenant can assert other legal claims against you. You can inform yourself about this on the Internet.
  • You are still our contact person. We will not have any contact with subtenants.
  • You still owe us the rent (and service fees) exactly the same, even if the subtenant pays you late or not at all.
  • You are responsible for any damages, breaches of contract or rules caused by your subtenant.
